Terms of Service

These Terms of Service ("Terms") govern your access to and use of paycrypto.me, our waitlist, our WooCommerce plugin, and any related integrations (together, the "Service"), operated by PayCrypto.Me ("we", "us"). By using the Service, you agree to these Terms.
1. Description of the Service
PayCrypto.Me provides software (including a WooCommerce plugin currently available in early access) that lets merchants accept cryptocurrency payments — Bitcoin on-chain, Lightning Network, and other networks as they're added — directly to wallets the merchant controls. Parts of the Service, including additional platform integrations, are still under active development and may change, be delayed, or be discontinued.
2. Non-Custodial Service
PayCrypto.Me is non-custodial: we never take possession of, or control over, your funds or your customers' funds, and we do not store private keys or seed phrases. Cryptocurrency payments are sent directly to wallet addresses that you configure and control. You are solely responsible for the security of your own wallets, private keys, and credentials.
3. Eligibility & Merchant Responsibilities
You must be legally able to enter into these Terms to use the Service. If you use the Service to accept payments as a merchant, you are solely responsible for complying with all laws that apply to your business, including tax, consumer protection, sanctions, and any anti-money-laundering (AML) or know-your-customer (KYC) obligations in your jurisdiction. PayCrypto.Me does not perform KYC/AML checks on your behalf.
4. Restricted Territories & Sanctions
You may not access or use the Service if you are located in, or a resident of, any country or territory subject to comprehensive U.S. or E.U. trade sanctions (including, without limitation, Cuba, Iran, North Korea, Syria, Russia, and the Crimea, Donetsk, and Luhansk regions), or if you are listed on the U.S. Treasury's Specially Designated Nationals (SDN) list or any equivalent sanctions list. We reserve the right to restrict or deny access to anyone we believe may violate this section.
5. No Financial, Legal, or Tax Advice
Nothing in the Service constitutes financial, legal, investment, or tax advice. Cryptocurrency values are volatile and transactions on public blockchains are generally irreversible. You should seek independent professional advice before making decisions related to cryptocurrency.
6. Intellectual Property
The PayCrypto.Me name, logo, and website content are owned by us or our licensors. Where we distribute software under an open-source license (such as our WooCommerce plugin on WordPress.org), that software is governed by its published license terms in addition to these Terms.
7. Service "As Is" & Availability
The Service, including any early-access or beta components, is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the Service will be uninterrupted, error-free, or secure.
8. Limitation of Liability
To the maximum extent permitted by law, PayCrypto.Me and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of funds, profits, or data, arising from your use of the Service — including losses caused by sending funds to an incorrect address, loss of private keys, or blockchain network issues outside our control. Our total cumulative liability for any claim arising out of or relating to the Service will not exceed the greater of (a) USD $100, or (b) the fees you paid us, if any, in the twelve months before the claim arose.
9. Dispute Resolution & Arbitration
Before filing a claim, you agree to try to resolve the dispute informally by contacting us at contact@paycrypto.me; we'll try to do the same. If a dispute isn't resolved within 60 days, you and PayCrypto.Me agree that it will be resolved by binding arbitration rather than in court, except that either party may bring an individual claim in small-claims court. You and PayCrypto.Me each waive the right to a jury trial and to participate in a class action or class arbitration — claims must be brought individually.
10. Changes to the Service or These Terms
We may modify or discontinue any part of the Service, and may update these Terms from time to time. We'll update the "Last updated" date above when we do; continued use of the Service after changes take effect means you accept the revised Terms.
11. Governing Law
These Terms are governed by the laws of the Cayman Islands, without regard to conflict-of-law principles, and any arbitration under Section 9 will be seated in the Cayman Islands.
